Amputations

Losing an arm, a leg, a hand or a foot is a loss like no other. You know that you are still the same person you were before the workplace accident, yet you probably cannot help feeling less than you were. Adapting to any amputation is a gradual process. You are no doubt grateful and relieved to even be alive after your brush with tragedy in a severe work-place accident. Yet you and those who care for you must cope with the aftermath of your amputation. The Florida WC law firm and attorneys know that it is never easy. We are here to help you.

Back Injury

Back injuries are some of the most common and frequently the most traumatic Florida Workman's Comp work-related injuries that a worker can experience. Back injuries can range in severity from simple sprains, to bulging to herniated disks, and even life threatening fractures. Back injuries can be extremely painful, chronic and disabling. In some cases, back injuries can require surgery to correct the problem.

Carpal Tunnel Syndrome

Carpal Tunnel Syndrome (CTS) is the most significant health problem in the workplace today. The United States Department of Labor has concluded that "CTS" is the "chief occupational hazard since the 90's - disabling workers in epidemic proportions." Every worker who develops Carpal Tunnel Syndrome or any other type of Repetitive Stress Injury as a result of performing his or her job is legally entitled to receive the comprehensive medical and monetary benefits provided by the Florida Workers' Compensation Act.

Chemical Exposure

The term "chemical exposure" is used to refer to contact with a variety of toxic or hazardous man-made substances. Many paints cleaning products, and on-the-job products contain dangerous chemicals that can damage the body when inhaled or touched. Unfortunately, many employers are either ignorant or cut corners when it comes to safety and education, properly storing dangerous chemicals, providing adequate training, and/or fail to provide the proper protective equipment. The results are often workers suffering short-term injuries such as respiratory symptoms, forgetfulness, or disorientation, or even long-term consequences like illness, internal damage, cancer, birth defects, neurological injury; even death.

Cuts & Lacerations

A laceration, or cut, is a common injury to get in a workplace. They can result from slips, trip or fall, exposed sharp surfaces, low overhangs, tools used on the job and many more causes. Lacerations are cuts or tears of the skin caused by a sharp object, such as broken glass, or a blunt trauma. Laceration wounds have a wide range of severity from surface to deep and can even be fatal. Long-term effects resulting from certain cuts and lacerations can be challenging for the worker. This page gives an overview of laceration injuries. If you have suffered cuts or lacerations as the result of a workplace accident in Florida, please contact Kevin the Florida Workmans' Comp law firm of Kevin Moore.

Death

In Florida's Workers' Compensation Law, death benefits are payable to an employee's surviving spouse, or spouse and children, based upon a percentage of the employee's wages, subject to a cap. A burial allowance is also available. If you are a qualified dependent of a Worker's Comp related death you will likely benefit from advice from a Qualified WC lawyer. Games can and have been played by employers and their insurance companies in determining the proper payments and calculating the qualifying period.

Dismemberment

Dismemberment Workers' Compensation claims are, for the most part, treated just like amputation claims. The fundamental difference is in the 'timing' of the loss of the body part. Dismemberments usually occur at the work location whereas amputations occur after the accident and in the hospital.

Head Injury

Even with OSHA requirements and the increasing awareness of workers of the risks of head and brain injuries on the job, such accidents and injuries remain on the rise. All too frequently seemingly minor head injuries are being ignored by workers and the real effects of these injuries are realized only after the time to file a claim with their employer has expired. If you have had any recent head injury on the job and have not reported it through your employers it would be a very good thing to do immediately.

Hearing Loss

If you suffer sudden hearing loss because of a workplace incident then you should report it to your employer IMMEDIATELY and file a Workmans' Comp report. If you believe you are suffering from a gradual hearing loss you should first try to protect yourself from further injury and then report it to your employer. Once this has been done you will benefit from a free consultation by your Workers' Comp attorney - Kevin Moore of the Kevin A Moore Workers' Compensation law firm.

Knee Injuries

Knee injuries are among the most common workplace injuries and the most easily injured part of the body. This is particularly true for occupations involving moving, lifting, overuse or overload. If you have suffered a knee injury as the result of a workplace accident in Florida, please Contact Kevin at the Florida Workmans' Comp law firm of Kevin Moore.

Neck Injuries

Neck injuries are among the most common workplace injuries and the neck is one of the most easily injured part of the body. Any part of your neck - muscles, bones, joints, tendons, ligaments or nerves - can cause it. Pain may also come from your shoulder, jaw, head or upper arms. Neck injuries can occur during occupational accidents or even every day work activities. Symptoms of these injuries include neck stiffness, shoulder or arm pain, headache, facial pain and dizziness. Pain from a work related injury may be caused by tears in muscles or injuries to the joints between vertebrae. Other causes of pain are ligament rupture or damage to a disc.

Pre-existing Conditions

Workers' Compensation claims involving injuries on or after October 1, 2003, have been subject to changes in the law, including a new definition of "pre-existing condition." Generally, a "preexisting condition" is a medical condition which a worker had prior to a claimed work injury or occupational disease, and which contributed to it. The definition is important since such conditions must be taken into account in determining whether the workers' compensation claim is compensable.

Repetitive Trauma

"Repetitive Trauma" is also referred to by the names "Repetitive motion injury" and "Repetitive Stress Injuries". Repetitive motion injury: As reported to the Bureau of Labor Statistics (BLS), disorders due to repetitive motion or musculoskeletal disorders of the upper extremity associated with workplace exposures to a combination of repetitive, forceful exertions and constrained or extreme postures. The term "repetitive motion injury" is no longer favored and has been replaced by "work-related musculoskeletal disorder" by the International Committee on Occupational Health Musculoskeletal Subcommittee. Back disorders are separately reported to the BLS as disorders due to over-exertion.

Sprains & Strains

Sprain A sprain can result from a fall, a sudden twist, or a blow to the body that forces a joint out of its normal position. This results in an over-stretch or tear of the ligament supporting that joint. Typically, sprains occur when people fall and land on an outstretched arm, land on the side of their foot, or twist a knee with the foot planted firmly on the ground.
